One of the 95% That Were successful - An EB1-C Business Plan
An immigration attorney in a well-known firm came to me needing a compliant EB1-C business plan. What was lacking was some of the most important required documentation. Missing was the support of the beneficiary's qualifying managerial experience abroad as well as her proposed position in the US. In addition, there was also no actual documentation of the qualifying relationship with the parent company.
The USCIS is not tolerant about required missing information. The burden of proof for an EB1-C is generally considered higher than for an L1A visa. This is because the EB1-C, being an immigrant visa, grants permanent residency, while the L1A is a non-immigrant visa for temporary workers. Consequently, USCIS adjudicates EB1-C petitions more strictly, requiring substantial evidence to demonstrate that the foreign national qualifies as a multinational manager or executive and that the U.S. employer meets all requirements.
I created a structure for a compliant plan that included meticulous documentation of the required information. I ensured that all documentation was available. The plan explained the business beautifully, emphasizing its viability and the impact it would have.

One of the 5% That Were Unsuccessful - An RFE Response
An immigration attorney came to us with an EB-5 RFE issued in part due to lack of financial transparency. Essentially, the client tried to include some ineligible preexisting debt in the capital structure. In addition, he did not--and would not--provide any documentation to support the exact amount he claimed for his equity contribution of land.
Especially after the passage of the RIA, the USCIS has become even more strict about transparency..
I presented a number of financial scenarios that would have been acceptable but the developer would have none of it. Likewise, he did not see why he should have to provide a verifiable breakdown of his construction costs.
Ultimately, after submitting a non-compliant RFE response, he received an NOID. A non-compliant RFE response to us means one that did not adequately or effectively answer the USCIS' questions.
